Healthcare Unconstitutional and other liberal disasters

Obamacare
...Vinson said the GOVERNMENT EVEN CONCEDED THAT ITS INTERPRETATION OF THE COMMERCE CLAUSE TO SUPPORT THE INDIVIDUAL MANDATE "BREAKS NEW LEGAL GROUND" AND IS "UNPRECEDENTED." He concluded, "If it has the power to compel an otherwise passive individual into a commercial transaction with a third party ... it is not hyperbolizing to suggest that Congress could do almost anything it wanted. It is difficult to imagine that a nation which began, at least in part, as the result of opposition to a British mandate giving the East India Company a monopoly and imposing a nominal tax on all tea sold in America would have set out to create a government with the power to force people to buy tea in the first place."

Vinson also turned the government's logic on its head in his ruling that the mandate is not severable from the rest of the legislation. ON THE ONE HAND, THE GOVERNMENT MAINTAINED THE MANDATE COULDN'T BE SEVERED FROM THE REST OF THE BILL BECAUSE IT WAS ESSENTIAL TO THE OPERATION OF THE ENTIRE HEALTH CARE REFORM PROGRAM. BUT THEN THE GOVERNMENT ARGUED CONVERSELY THAT THE MANDATE WAS SEVERABLE BECAUSE THE 2,700-PAGE BILL CONTAINED MANY PROVISIONS ONLY TANGENTIALLY RELATED TO HEALTH CARE. Severing the mandate was also impossible, Vinson said, because he would then have to rule on how doing so affected each of the hundreds of provisions in the law. Doing that, Vinson argued, would require him to exceed his own authority as a judge by acting as a legislature....

ABC, CBS and NBC on Monday night devoted more than half of their evening newscasts to the turmoil in Egypt, but while CBS AND NBC SQUEEZED IN BRIEF MENTIONS OF HOW A FEDERAL JUDGE AGREED WITH 26 STATES THAT THE ENTIRE OBAMACARE LAW IS UNCONSTITUTIONAL, ABC’S WORLD NEWS DIDN’T UTTER A SYLLABLE ABOUT THE MAJOR SETBACK FOR THE OBAMA ADMINISTRATION. Anchor Diane Sawyer, however, made room for a full story on an impending snowstorm and four minutes for a new series, “Families on the Brink: What to Do About Mom and Dad?”

The cost of oil

In case you haven’t noticed, OIL PRICES IN THE UNITED STATES DIFFER FROM THOSE IN THE REST OF THE WORLD. Usually the variance is just a few dollars, but over the last few weeks the difference between West Texas Intermediate prices and Brent crude, which is sourced in Europe’s North Sea, has widened to about $10.

That means that while Americans are buying oil at just over $90 a barrel, the price Europeans and Asians are paying is already over $100. And if the turmoil in Egypt spreads to its oil fields and the Suez Canal, a major transit point for European supplies, THAT SPREAD COULD EXPAND EVEN MORE.

But so far the spread, which began widening before demonstrators took to the streets of Cairo, has little to do with the Middle East. It is mostly about a big buildup of crude in the Cushing, Okla., oil depot. CUSHING IS FLUSH PARTLY BECAUSE DEMAND IN THE UNITED STATES IS ONLY SLOWLY RECOVERING. BUT MOST OF ALL, IT IS A RESULT OF INCREASING IMPORTS OF REFINED SYNTHETIC OIL PRODUCED FROM CANADIAN OIL SANDS, now the single most important source of imported oil.

The price of oil is being artificially inflated by the turmoil in the Mideast. But the Mideast is losing its place as the cradle for oil. Rather than peak oil, we keep finding more and more oil in new locations. Last year we discovered 67% more oil than we used.

How do taxes work?

During his State of the Union address, President Obama said the current tax system is broken. "Those with accountants or lawyers to work the system can end up paying no taxes at all," he said. "But all the rest are hit with one of the highest corporate tax rates in the world. It makes no sense, and it has to change."

Just how broken is the corporate tax system? Consider the tax rate paid by two of America's biggest companies — WAL-MART AND GENERAL ELECTRIC. WAL-MART PAID 34 CENTS IN TAXES FOR EVERY DOLLAR OF PROFIT IT MADE IN THE PAST THREE YEARS. GENERAL ELECTRIC PAID JUST 3.6 CENTS ON THE DOLLAR.

Welcome to the mysterious world of the corporate income tax, says tax expert Len Burman at Syracuse University. "There are big companies that consider their tax departments to be profit centers," he says.

That's right; INSTEAD OF CONCENTRATING ON MAKING LIGHT BULBS, POWER PLANTS OR WHATNOT, COMPANIES USE THE TAX SYSTEM TO BOOST THEIR PROFITS.

GE has been a big contributor to the Democratic Party. Obviously that pays off.

What Independents Want

…..That’s the finding of Resurgent Republic, a Republican polling outfit that applied the views of independents to the House. For instance, 63 PERCENT OF INDEPENDENTS OPPOSED THE MANDATE TO BUY HEALTH INSURANCE in Resurgent Republic polling. That translated into 276 House seats, a solid majority.

The views of independents are crucial because they represent the nation’s critical bloc of swing voters. Their switch away from Democrats in 2010 produced a Republican landslide. Independents overwhelmingly voted for President Obama in 2008 and Democratic congressional candidates in 2006 and 2008…..

Applying their views to the House, THE RIGHT TO PURCHASE HEALTH INSURANCE ACROSS STATE LINES – WHICH IS CURRENTLY ILLEGAL – WOULD PASS 334 TO 101. Repeal of Obamacare would be approved 244 go 191, almost identical to the 245 to 189 vote for repeal in the House in January. REMOVING THE INDIVIDUAL MANDATE WOULD PASS 267 TO 168.

On fiscal issues, the views of independents are remarkably conservative. Were they in charge, THE HOUSE WOULD VOTE 231 TO 204 TO CANCEL UNSPENT ECONOMIC STIMULUS FUNDS and use the money to reduce the deficit. A measure to freeze total federal spending at 2010 levels would pass 260 to 175. THE REQUIREMENT OF A TWO-THIRDS MAJORITY TO PASS NEW SPENDING WOULD BE APPROVED 282 TO 153…..

More bad news for the left.

It’s almost unanimous

A recent Gallup poll shows that ONLY 5 PERCENT OF AMERICANS FAVOR INCREASED STIMULUS SPENDING AS THE BEST APPROACH TO IMPROVING THE U.S. ECONOMY.

The poll also found that when broken down by party affiliation only 9 percent of self described Democrats see increased stimulus spending as a the best way to get the U.S. economy moving again

Unfortunately, in that 9% are a lot of elected Democrats in Washington.

Fannie and Freddie and reform

THE OBAMA ADMINISTRATION FAILED TO RELEASE A REPORT TODAY ON HOW FREDDIE MAC AND FANNIE MAE COULD BE REFORMED, despite being required to do so by the Dodd-Frank law passed last summer.

Rep. Jeb Hensarling (R., Texas), who chairs the House Republican Conference, said in a statement that the White House’s failure to meet the deadline MADE IT “CRYSTAL CLEAR THAT THE PRESIDENT IS NOT SERIOUS ABOUT REFORMING FANNIE MAE AND FREDDIE MAC.”

“The Obama Administration’s repeated inability to propose a plan to reform Fannie Mae and Freddie Mac calls into question their commitment to taxpayer protection and their ability to effectively govern on this issue,” Hensarling added. “After more than $150 billion in Fannie and Freddie bailouts, we can no longer afford to allow the Administration to kick the can down the road.”

FILMMAKER DAVID GUGGENHEIM UNLEASHED A WEALTH OF CONTROVERSY LAST SEPTEMBER WITH THE RELEASE OF HIS DOCUMENTARY “WAITING FOR SUPERMAN,” which tackled the failures of the American public education system. But five months later, Guggenheim said THE BACKLASH AGAINST HIM FROM TEACHERS’ UNIONS REMAINS STRONG, and he blames them in large part for not allowing improvements to be implemented into the system.

“The hardest part (of making the film) was the unions and the teacher's union is one (part) of why we aren't going as fast as we can with the reforms,” Guggenheim told FOX411’s Pop Tarts at the Directors Guild of America (DGA) Awards in Hollywood on Saturday night, where he was nominated for Outstanding Achievement in Documentary Feature filmmaking. “AND THAT WAS A DIFFICULT PIECE BECAUSE I BELIEVE IN UNIONS – I'M A MEMBER OF THE DIRECTOR'S GUILD, THE UNION TONIGHT. THAT'S A DIFFICULT THING TO SORT OF DISSECT THAT ISSUE.”

The teachers’ unions in question were not immediately available for comment.

But even though change isn’t happening as fast as Guggenheim would like, HE TAKES PRIDE IN THE FACT THE FILM SIMPLY SPARKED FODDER FOR DEBATE.

The problem isn’t unions per se, but rather public employee unions. Businesses have to compete in the marketplace. Teachers Unions in the meantime not only don’t have to compete in the marketplace, but use political clout to keep their monopoly alive.

Whose to Blame?


It’s interesting to watch was it being said online. This past summer I saw more and more generic polling indicating the Republicans were way ahead of the Democrats. I’m now seeing more and more articles trying to determine what happened to the Democrats and who’s to blame for what looks like will be happening in November.


Occasionally you see article talking about how it might not be so bad for the Democrats, but if you are following this closely you know it’s pretty well over for them. What we are really waiting to see is just how big the Republican wave will be. As Michael Barone asked, will it be 1994 again (Democrats lost 54 seats) or 1894 again (Democrats lost 100 seats).


An important fact is that every time there has been a major shift in the House of Representatives, the Senate has also been lost by the ruling party. Not good news for the Democrats in the Senate who figured to sail by this year.

Do we have a tax problem or a spending problem?


According to Congressional Budget Office (CBO) data, extending the tax cuts on top earners would create a budget shortfall of $700 billion over ten years. That’s $70 billion a year. Meanwhile, extending the tax cuts on the middle class would create a budget shortfall of $3,000 billion over ten years.


Now, thinking like a government official, this means that extending the tax cuts would “cost” the government $3.7 trillion over ten years. This sounds like a lot of money, but let’s put it in perspective and look at how much the federal government will be spending over the course of the next ten years.



Hispanic voters may sit this election out

Here's more bad news for the Democrats.
"They show the very same enthusiasm gap. Republican Latinos are more
positive, the Democratic Latinos are more demoralized. How is that different
from anyone else? It isn't," said James G. Gimpel, a government professor at the
University of Maryland who studies voting and immigration policy.


"Rather, they rank education, jobs and health care as their top
three issues of concern for this year's congressional campaign. Immigration
ranks as the fifth most important issue for Latino registered voters," said Mark
Hugo Lopez, associate director of the center and the report's author.

WASHINGTON – Desperate for jobs and cool toward President Barack Obama,
working-class whites are flocking to Republicans, turning a group long wary of
Democrats into an even bigger impediment to the party's drive to keep control of
Congress.

An Associated Press-GfK poll shows whites without four-year college
degrees preferring GOP candidates by twice the margin of the last two elections,
when Democrats made significant gains in the House and Senate. The poll,
conducted last month, found this group favoring GOP hopefuls 58 percent
to 36 percent — a whopping 22 percentage-point gap.

Recently Joe Biden made the charge; this isn’t your father’s GOP. That probably goes double for the Democrat Party. It isn’t the party of the working man anymore.


The Democrats are widening the enthusiasm gap

The Democrats are widening the enthusiasm gap against them by running
exclusively negative campaigns against their insurgent Republican rivals. The
vast proportion of Democratic and allied independent-expenditure media is
negative, portraying Republican congressional candidates as tax evaders, spousal
abusers, mob-linked, eccentric flakes, sexual molesters and absentee
officeholders (all actual charges against key GOP candidates). While these ads
may chip away at the Republican vote share in the polls, they do nothing
to generate a Democratic turnout.


The Democrats are without a theme, a message or a positive reason
to go vote. Negative ads are supposed to depress turnout — the
last thing Democrats need. But when they come up against Republican enthusiasm, they may not do much to check the GOP rise.



Why are the Democrats not as enthusiastic as the Republicans
Here’s an interesting look at the lack of Democrat enthusiasm. I noticed at the One Nation Rally that parts of the demonstrators were demonstrating against Obama. This article explains it.
So why are Democrats less enthusiastic? And why has "the progressive
donor base," as Democratic consultant Jim Jordans reports, "stopped writing
checks"?


I don't think it's just because the economy remains sour or that
President Obama failed to jam a public option in the health care bill.


I find a more convincing explanation in an offhand phrase in a
subordinate clause in a brief article by Adam Serwer of the Center for American
Progress on the Washington Post's opinion pages. "There's no question," Serwer
writes, defying anyone to disagree, "that Obama has completely reversed on his
promises to roll back Bush-era national security policies."


For it is not economics but foreign policy that has motivated the
left half of the Democratic Party over the last decade.


I also found this article by Victor David Hansen which nicely fits with the article above. Notice what has happened to our foreign policy under President Obama.

But suddenly Barack Obama’s brief tenure has reminded us that, in fact,
almost all the world’s crises arose before the Bush presidency and continued
during and after it. Examine current American foreign policy toward every
region, and one of three general patterns emerges: Either things are no better since the end of 2008, or they are much worse, or the Obama administration has reverted to the Bush way of doing things — despite constant assurances to the world that Bush was at fault, American foreign policy was now reset, and global animosity arose out of past misunderstanding, insensitivity, and American hubris.



This is a pretty interesting article. I highly recommend it.

Obama was elected as the corrective to the Bush years. Yet when you're
the winner, the temptation is always there to see yourself as something more
than just an alternative -- something larger, like a paradigm-changer or a
transformational political figure. And Obama wanted nothing less than a change
from conservatism to his own brand of 21st century activism.

"When you win an election," says political scientist Bill Galston, "you are always
inclined to believe you won for the reasons you wanted to win."

In other words, you believe you won for the big stuff, not just because the voters didn't like the other guy.

...... Maybe he overestimated his personal capacity and appeal. Or his mandate. Or the extent to which the nation is actually divided on both principle and policy. Some, including his own pollster, according to knowledgeable sources, counseled caution. People wanted the president to focus on the economy, some told the president: Don't go for it all now.


But he did, precisely because he was riding high, ready to use his political capital.

Private sector sheds 39,000 jobs in September
More disasterous news for the Democrats.

NEW YORK (Reuters) - Private employers unexpectedly cut 39,000 jobs
in September after an upwardly revised gain of 10,000 in August, a report by a
payrolls processor showed on Wednesday.


The August figure was originally reported as a loss of 10,000.

The median of estimates from 38 economists surveyed by Reuters for
the ADP Employer Services report, jointly developed with Macroeconomic Advisers LLC, was for a rise of 24,000 private-sector jobs in September.

Minnesota Congressional Race Gets Profane

Democratic Minnesota congressional candidate and state Sen. Tarryl Clark
released a provocative video on her campaign Web site today, one including a few
choice words for her opponent, incumbent GOP Rep. Michele Bachmann. The spot's voice-over accuses Bachmann of standing up for "special interests" in Washington and backing BP during the fallout over the Gulf Coast oil spill, while
concluding that she's "not doing @#%! for the people of the Sixth District."
(The presumed expletive is bleeped out.)

This is a sure sign of desperation. You’ll hear more of this as we get closer to November 2.

Panel: Gov't thwarted worst-case scenario on spill

Incompetence on display

WASHINGTON — The Obama administration blocked efforts by government scientists to tell the public just how bad the Gulf oil spill could become and made other missteps that raised questions about its competence and candor during the crisis, according to a commission appointed by the president to investigate the disaster.

In documents released Wednesday, the national oil spill commission's staff describes "not an incidental public relations problem" by the White House in the wake of the April 20 accident.
Among other things, the report says, the administration made erroneous early estimates of the spill's size, and President Barack Obama's senior energy adviser went on national TV and mischaracterized a government analysis by saying it showed most of the oil was "gone." The analysis actually said it could still be there.

"By initially underestimating the amount of oil flow and then, at the end of the summer, appearing to underestimate the amount of oil remaining in the Gulf, the federal government created the impression that it was either not fully competent to handle the spill or not fully candid with the American people about the scope of the problem," the report says.

European nations do not have to allow same-sex marriage, the European Court of Human Rights has ruled, though gay rights groups claimed a partial victory Friday because the court acknowledged growing agreement that their relationships should be recognized in law.

Seven judges at the European court ruled unanimously that two Austrian men denied permission to wed were not covered by the guarantee of the right to marry enshrined in Europe's human rights convention.

Coloradans favor an Arizona Immigration law for Colorado

61% of people polled favor an Arizona type immigration law for Colorado. 34% oppose it and 5% are undecided. Once again, the Democrat party finds itself on the wrong side of public opinion. November is going to be a nightmare for you if you are a Democrat.

Independent voters are now indistinquishable from Republicans

Earlier this month, Resurgent Republic conducted focus groups in five key House districts, measuring how independent voters and, separately, self-identified tea-party members felt about the direction of the country.

What they found wasn't simply bad news for President Obama and congressional Democrats, but simply dismal news. Asked to compare Obama to a car, one Iowan chose an Edsel: “Something that had a lot of hype, but failed to live up to expectations.” Another older man described Obama as “a wrecked Ferrari, something that looked great to many people, but was now ruined.”

“Independents are now thinking about the same issues that Republicans are, and their thinking is virtually indistinguishable from Republicans,” he said. “Independents are really engaged, they are really paying attention. That is not normal; usually independents are a little tuned out.”



Better Late Than Never

On June 29, over seventy days after the Gulf oil spill, the U.S. Department of State released the following statement:

"The National Incident Command and the Federal On Scene Coordinator have
determined that there is a resource need for boom and skimmers that can be met
by offers of assistance from foreign governments and international bodies. The United States will accept 22 offers of assistance from 12 countries
and international bodies
, including two high speed skimmers and fire
containment boom from Japan. We are currently working out the particular
modalities of delivering the offered assistance. Further details will be
forthcoming once these arrangements are complete."
