Obama's problems keep multiplying

1.  OSHA and Other Rogue Regulators

….After months of interviewing employees, reviewing documents, and taking videotaped tours of the hospital, OSHA ISSUES THE HOSPITAL A CITATION AND FINE (!) ON THE BASIS THAT THE VIOLENCE WAS FORESEEABLE AND THE HOSPITAL DID NOT DO ENOUGH TO PREVENT IT.

As you may have guessed, the above inspection is not so hypothetical. On Sept. 8, OSHA issued a directive to its investigators regarding how to inspect -- and cite -- employers for instances of workplace violence.

If you're wondering where to look up the federal law or regulation that tells employers how to avoid a citation for workplace violence, don't bother. OSHA HAS ISSUED THIS DIRECTIVE UNDER THE ASSUMPTION THAT A VAGUE CLAUSE OF THE OCCUPATIONAL SAFETY AND HEALTH ACT GIVES OSHA THE POWER TO CITE EMPLOYERS FOR SOMETHING AS SPECIFIC AND UNPREDICTABLE AS WORKPLACE VIOLENCE.

KNOWN AS THE "GENERAL DUTY CLAUSE," this provision requires employers to keep their workplaces "free from recognized hazards that are causing or are likely to cause death or serious physical harm" to employees.

CONGRESS INTENDED FOR THIS CLAUSE TO BE USED ONLY AS A TEMPORARY MEASURE, UNTIL OSHA COULD DRAFT RULES REGARDING SPECIFIC HAZARDS THAT HAD THE AGENCY HAD NOT YET ADDRESSED. It was not intended to be used as a means for OSHA to issue citations for anything under the sun.

Yet in the past several years, OSHA has used the General Duty Clause to cite companies for issues as varied as crowd control, heat stress, and even the use of killer whales in SeaWorld shows.

NOW, OSHA SEEKS TO TAKE THE GENERAL DUTY CLAUSE ONE STEP FURTHER, AND TO USE IT TO HOLD EMPLOYERS LIABLE FOR ACTIONS TAKEN BY PEOPLE WHO ARE NOT THEIR EMPLOYEES…

If someone is not an employee and they are injured, they have redress through the courts and most business have liability insurance to handle this.  Another example of government’s overreach.



2.  Tea Party vs OWS

It arose spontaneously in response to the spending madness of Obama, Reid, and Pelosi, in the midst of Obama's frenzied rush to pass trillion-dollar bills with thousands of unread pages. ITS MESSAGE TO WASHINGTON WAS AND IS "GET BACK TO THE CONSTITUTION, CUT SPENDING, AND LET'S LIVE WITHIN OUR MEANS."…

… Titanic spending and taxing initiatives of the federal government are the fundamentals of the new collective morality of the left. THE CENTRALIZED FEDERAL GOVERNMENT IS LOOKED TO AS THE SAVIOR OF THE MASSES. Part of the moral construct of the new secular religion involves the federal government taking from the "rich" and spreading the wealth to the poor. TO THE NEW LEFT, IT'S A MATTER OF MORALITY FOR THE GOVERNMENT TO SHARE THE EARNINGS OF PRIVATE CITIZENS IN A WAY THAT IS "FAIR."..

3.  What Progress looks like in Obama’s America



Unemployment stands at 9.1 percent, with real unemployment closer to 20. Nearly 50 million Americans are on food stamps. We’ve added $4 trillion in new debt in less than three years. And there’s no sign any of this will change soon.

THE SERIOUSNESS OF THE TIMES REQUIRE SERIOUS LEADERS...AND ALL WE HAVE IS BARACK OBAMA, CONGRESSIONAL DEMOCRATS AND A SEA OF UNWASHED “GIMMIE-CRATS” SLEEPING IN PARKS DEMANDING MORE. WELCOME TO PROGRESSIVE AMERICA.

As more “Green” scandals involving “friendly” treatment of friends and fundraisers for the president emerge, no one with a “D” after his or her name seems to give a damn. Why would they? It’s not their money. SPENDING OTHER PEOPLE’S MONEY IS FUN. Spending two as-yet-unborn generations’ money is even more fun because you won’t be around when they realize what you’ve done to them. It’s the progressive way…



Not all our problems are Obama’s fault, of course. BUT HIS PROGRESSIVE “SOLUTIONS” TO THE PROBLEMS HE INHERITED AMOUNT TO BLOWING A HOLE IN THE SIDE OF A SINKING SHIP IN HOPES OF LETTING THE WATER OUT. It might seem like a good idea on paper but only if you don’t actually consider the problem in the solution.


I liked the analogy about what the Progressive solutions amount to.



4.   Top 10 Problems for BHO and the Democrats



Bad omens abound for President Obama in his quest to win reelection in 2012. The President will have an uphill battle in his bid for a second term when faced with these Top 10 Bad Signs.

1. JOBLESS RATE: The unemployment rate is STUBBORNLY STUCK AT AROUND 9%, with no sign of abating. Obama is reduced to running around the country touting his phony jobs bill and blaming others (President Bush, Japanese tsunami, Arab Spring, European debt, Tea Party) for the sad state of affairs.

2. FAST AND FURIOUS: The gunrunning saga is playing out as a classic Washington scandal that keeps getting bigger as “who-knew-what-when” is unraveled. With pit bull Rep. Darrell Issa putting Eric Holder on the hot seat, and possible tentacles into the White House, EXPECT THIS ONE TO HEAT UP DURING THE PRESIDENT’S REELECTION CAMPAIGN.

3. SOLYNDRA: The bankrupt solar-panel firm, which wasted half-a-billion dollars of taxpayer money while the White House was obsessed with a photo-op, is another scandal exploding at the worst time for Obama. NOT ONLY DOES IT RAISE QUESTIONS ABOUT THE PRESIDENT STEERING FEDERAL FUNDS TO POLITICAL SUPPORTERS, IT MAKES OBAMA’S PROMISE OF A GREEN-JOBS REVOLUTION LOOK HOPELESSLY NAÏVE.

4. POLL NUMBERS: Obama’s approval rating just keeps dropping, scraping the low-40s in poll after poll. Less than 20% of the population believes the country is on the right track. His base is depressed, he seemingly has lost the independent vote, and the enthusiasm of 2008 is gone for young voters….

5.  The Coming American Revival

Assumptions that the Great Republic must inevitably spiral into economic and strategic decline - so like the chatter of the late 1980s, when Japan was in vogue - will seem wildly off the mark by then.

Telegraph readers already know about the "SHALE GAS REVOLUTION" THAT HAS TURNED AMERICA INTO THE WORLD’S NUMBER ONE PRODUCER OF NATURAL GAS, AHEAD OF RUSSIA.

Less known is that the technology of hydraulic fracturing - breaking rocks with jets of water - will also bring a quantum leap in shale oil supply, mostly from the Bakken fields in North Dakota, Eagle Ford in Texas, and other reserves across the Mid-West.

"THE US WAS THE SINGLE LARGEST CONTRIBUTOR TO GLOBAL OIL SUPPLY GROWTH LAST YEAR, with a net 395,000 barrels per day (b/d)," said Francisco Blanch from Bank of America, comparing the Dakota fields to a new North Sea.

Total US shale output is "set to expand dramatically" as fresh sources come on stream, possibly reaching 5.5m b/d by mid-decade. This is a tenfold rise since 2009.

Cheap energy will bring America back from the precipice that we are experiencing today.  Instead of pouring money into wind and solar, the US needs to harvest the gifts we have.  Rather than being at Peak Oil, we are more likely to be at the beginning of the age of fossil fuels.  





6.   Obama Scandal Update:  Solyndra



As part of its bankruptcy proceedings, defunct solar company Solyndra will auction off thousands of items from its California production facility on Nov. 2 and 3. BUT TAXPAYERS WON’T SEE A DIME OF THE PROCEEDS, DUE TO THE ENERGY DEPARTMENT’S DECISION TO SUBORDINATE TAXPAYERS TO SOLYNDRA’S PRIVATE FINANCIERS IN REPAYMENT OF THEIR INVESTMENTS.



… DOE has developed an UNPRECEDENTED INTERPRETATION OF THE LAW TO ALLOW SOLYNDRA’S PRIVATE INVESTORS TO RECOUP $75 MILLION OF THEIR INVESTMENT BEFORE TAXPAYERS ARE REPAID.



Heritage Global Partners, which is conducting the auction, told Scribe that the money raised “will not be anywhere near” $75 million, meaning the proceeds will go entirely towards repaying Solyndra’s private investors (though later asset sales may exceed that threshold)….
