Obamacare: Unconstitutional in 26 states and More on Egypt

Obamacare: What’s the current status?

….But in sharp contrast to this reading, THE OBAMA ADMINISTRATION HAS IMPLIED THAT THE RULING HAS NO EFFECT WHATSOEVER. “Implementation will continue,” promised Stephanie Cutter, assistant to the president and a deputy senior adviser, in a White House blog post. She provided quotes from experts to support the administration’s position — all but one of which merely DISAGREED WITH THE RULING, RATHER THAN ASSERTING THAT IT DIDN’T HAVE THE FORCE OF LAW.

The CONSENSUS AMONG THE LEGAL SCHOLARS I spoke with is somewhere in between: THE RULING PREVENTS IMPLEMENTATION, BUT ONLY REGARDING THE PARTIES OF THE SUIT — 26 STATES, PLUS TWO INDIVIDUALS, AND THE NATIONAL FEDERATION OF INDEPENDENT BUSINESSES. “There is absolutely no doubt that we have obtained a binding judgment from a federal district court,” says David B. Rivkin Jr., a Baker Hostetler attorney and lead outside counsel to the plaintiffs. “Unless and until the federal government is able to obtain a stay . . . this absolutely precludes the government from implementing any provisions of the act — and this is important — with regard to the parties of the case.”

Kevin C. Walsh, an assistant professor at the University of Richmond Law School, says the main issue is THE DOCTRINE OF “PRECLUSION.” This doctrine holds that once two parties — in this case, the federal government and the plaintiffs — have litigated a matter in court, the matter is settled between them, AND THEY CANNOT RELITIGATE IT FROM THE BEGINNING (though the loser can appeal the decision to a higher court). BUT WHEN THE FEDERAL GOVERNMENT IS THE DEFENDANT, PRECLUSION DOESN’T APPLY TO ENTITIES THAT WERE NOT INVOLVED IN THE SUIT. This means the federal government can implement the law with regard to everyone but the plaintiffs….

This is very interesting article and I recommend you read it. Of course it ends by saying this will be going to SCOTUS.

Can you be a democrat and be conservative?

For Democrats, Ashley Bell was the kind of comer that a party builds a future on: A YOUNG AFRICAN AMERICAN LAWYER, HE SERVED AS PRESIDENT OF THE COLLEGE DEMOCRATS OF AMERICA, ADVISED PRESIDENTIAL CANDIDATE JOHN EDWARDS AND SPOKE AT THE 2004 DEMOCRATIC NATIONAL CONVENTION IN BOSTON.
But after his party's midterm beat-down in November, Bell, a commissioner in northern Georgia's Hall County, jumped ship. HE JOINED THE REPUBLICANS.
Bell, 30, said he had serious issues with the healthcare law and believed that conservative "blue dog" Democrats in Congress who shared his values had been bullied into voting for it.

BELL'S DEFECTION IS ONE OF DOZENS BY STATE AND LOCAL DEMOCRATIC OFFICIALS IN THE DEEP SOUTH in recent months that underscore Republicans' continued consolidation of power in the region — a process that started with presidential politics but increasingly affects government down to the level of dogcatcher.

"I THINK THE MIDTERMS SHOWED YOU REALLY CAN'T BE A CONSERVATIVE AND BE A MEMBER OF THE DEMOCRATIC PARTY," Bell said…..

Another sign that the Democrats and the Obama Administration are badly out of step with the rest of the country.

Egypt: Here come the Marines

A senior member of the US Marine corps is telling people "multiple platoons" are deploying to Egypt, a source tells us.

THERE IS A SYSTEM WITHIN THE US MARINES THAT ALERTS THE IMMEDIATE FAMILIES OF HIGH-RANKING MARINES WHEN THEIR MARINE WILL SOON BE DEPLOYED to an emergency situation where they will not be able to talk to their spouses or families.

THAT ALERT JUST WENT OUT, SAYS OUR SOURCE…..

….On Friday, the Pentagon announced it would move "U.S. WARSHIPS AND OTHER MILITARY ASSETS TO MAKE SURE IT IS PREPARED IN CASE EVACUATION OF U.S. CITIZENS FROM EGYPT BECOMES NECESSARY," according the the LA Times
.

Nothing unusual about this. It’s makes good sense to be prepared.

Stein on Egypt: it's not going to be good for America

There is a wonderful scene in Ferris Bueller's Day Off when Ferris, played perfectly by Matthew Broderick, tells us that he's missing his class on European Socialism by taking a day off. But what does that matter? (as he asks). "I'm not a socialist. I'm not European. I don't plan to be European." (Paraphrasing here.)

I am reminded of John Hughes' deathless lines as I WATCH THE BREATHLESS, ENDLESS COVERAGE OF THE RECENT TURMOIL IN EGYPT ON TV. I don't doubt that it's terribly important. I just don't see the story the way it's being played on TV and here's why.

Let's take it point by point. No matter how this turns out, it's not going to be good for America. THE PEOPLE IN CAIRO, ALEXANDRIA, AND SUEZ DEMONSTRATING AGAINST MUBARAK ARE NOT JEFFERSON, MADISON, AND WASHINGTON. THEY ARE NOT LIBERAL DEMOCRATS AND BELIEVERS IN UNIVERSAL HUMAN RIGHTS. In the final analysis, they are not going to be pals of the United States or our only reliable friend in the area, Israel…..

….Yes, indeed, all of these demonstrations are a sign of a new dawn in the Mideast. But IT'S A LOT LIKE THE OLD DAWN, EXCEPT FOR A THICK HAZE OF IRANIAN SMOKE. Has no one noticed that in all of the recent political changes in the Arab states, power going to persons largely sympathetic to Iran is a constant? Has anyone noticed how MOHAMED ELBARADEI ENDLESSLY CARRIED WATER FOR IRAN ABOUT NUCLEAR ARMS WHEN HE WAS AT THE UN SUPPOSEDLY TRYING TO STOP NUKE PROLIFERATION? This is not going to end well for the U.S. ….

In case you missed it, Mr. Stein doesn’t think the turmoil in Egypt is going to end well for the US.

More on Egypt—who’s winning?

As the veteran president regained some of the initiative lost during nearly a fortnight of street protests, the Brotherhood, Egypt's popular but banned opposition, dropped its opposition to talks.

MR MUBARAK WAS ALSO BOOSTED BY A RETURN TO RELATIVE NORMALITY IN THE CITY, WHICH WAS CLOGGED BY FAMILIAR TRAFFIC JAMS FOR THE FIRST TIME IN DAYS.

Tens of thousands of protesters again thronged Cairo's Tahrir Square, but for the first time there WAS SERIOUS TENSION WITH THE ARMY, WHOSE ROLE IN TIGHTENING SECURITY IN THE CITY AND IN ARRESTING ACTIVISTS HAS DASHED HOPES THAT IT WAS TURNING AGAINST THE REGIME.

Omar Suleiman, the vice-president overseeing talks for the regime, offered leaders of the Muslim Brotherhood and other opposition parties a string of often vague concessions…..

Things seem to be calming down which is good for the USA and Israel. It appears Mubarak may be able to serve out his term in office.

U.S.-Egypt Relations Under Attack

We all want to see democracy succeed in Egypt, but there is good reason to believe that the CURRENT POLITICAL CRISIS IN THAT COUNTRY IS GEARED TOWARD BREAKING EGYPT'S CLOSE TIES WITH THE UNITED SATES, NOT TOWARD INSTALLING DEMOCRACY THERE. From my vantage point, I see this crisis as an updated version of the Kremlin's highly secret Cold War effort to turn the Islamic world into an enemy of the United States. In my other life as a top figure in the KGB intelligence community, I was involved in that effort, as I have described elsewhere ("Russian Footprints," National Review Online, August 24, 2006[1]).

It is noteworthy that the current Middle East rebellion is taking place only in Islamic countries that are pro-American and that the people demanding democracy there are burning the flag of the country symbolizing democracy for most of the world -- the United States. It is remarkable that these "mass uprisings" were so secretly planned that the entire U.S. intelligence community was taken completely by surprise -- President Obama admonished National Intelligence Director James Clapper for his "failure to predict the outbreak of these demonstrations" [2].

Even more significant is that the Hezb'allah representatives demonstrating on the first day of the Cairo uprising were carrying flags displaying the hammer and sickle. That was evidently a mistake caused by overzealousness -- my enthusiastic young subordinates in the Romanian foreign intelligence service (the DIE) sometimes used to make similar goofs. In Cairo, the error was quickly rectified, and now the hammer and sickle is nowhere to be seen.

Here's a bit of truth at least for some of the demonstrators.

Republican foreign policy "wolf" shows her teeth

For years, REPRESENTATIVE ILEANA ROS-LEHTINEN has been busy lecturing world leaders over human rights abuses.

Now that she is the NEW REPUBLICAN CHAIR OF THE HOUSE FOREIGN AFFAIRS COMMITTEE, she has a chance to try to back up her muscular rhetoric with action.

Last month, Ros-Lehtinen was one of THE FIRST U.S. LAWMAKERS TO URGE EGYPTIAN PRESIDENT HOSNI MUBARAK TO HOLD FREE ELECTIONS. Earlier in January, she told visiting CHINESE PRESIDENT HU JINTAO TO HIS FACE THAT HE SHOULD FREE JAILED DISSIDENT LIU XIAOBO, a Nobel peace prize winner.

Last year, the Florida Republican hand-delivered a letter to Russian President Dmitry Medvedev telling him Russia's human rights record was "deplorable."

A CUBAN-AMERICAN, ROS-LEHTINEN HAS CALLED FORMER CUBAN PRESIDENT FIDEL CASTRO A "DINOSAUR" and Venezuelan President Hugo Chavez a "thugocrat." Sometimes she gets as good as she gives; CASTRO CALLS HER "THE FEROCIOUS SHE-WOLF" AND CHAVEZ HAS DUBBED HER AN "OUTLAW."

Well this should be interesting in the coming years. A congresswoman who actually acts on her principles.

HERITAGE FOUNDATION: "How Modern Liberals Think"

Here’s a very good presentation on how liberal think. Even Sayet is a comedian who is a 9/13 Republican. Raised a liberal and previously working for Bill Maher, Sayet has spent the last five years looking at what’s going on in the mind of the liberals.

Reagan: Looking back

REAGAN’S CRITICS CONSIDERED HIM GREGARIOUS, PERHAPS, BUT ULTIMATELY A MERE ACTOR WHO READ WHATEVER LINES HE WAS HANDED by such advisers as former White House counselor Ed Meese and the late media man Mike Deaver. The equally late Democratic eminence CLARK CLIFFORD FAMOUSLY DISMISSED REAGAN AS “AN AMIABLE DUNCE.”

THE ANDERSONS’ BOOK, REAGAN, IN HIS OWN HAND, DETONATED THIS MYTH. They discovered 670 scripts for commentaries that the former California governor aired on 236 radio stations from 1975 to 1979. Reagan offered his specific prescriptions on taxes, regulation, peace through strength, and even oceanic mineral content as it concerned the Law of the Sea Treaty. These scripts consisted of sheets of yellow legal paper brimming with Reagan’s own cursive handwriting.

Rather than a mere mouthpiece for his staff, REAGAN HIMSELF RESEARCHED AND ADDRESSED TOPICAL ISSUES WITH PHILOSOPHICAL CONSISTENCY AND CONCRETE EVIDENCE TO BOLSTER HIS OPINIONS.

It appears RR’s stature is going up and should be. The lefts premise seems to be all conservatives are fools and the MSM is a co-conspirator in putting that forward. In fact, when you look at how the lefts plans and programs never seem to work out, you might want to question their credibility in making these charges against their opponents.

Bleak Midterms for Democrats are coming

Official Seal of the Democrat Party
Democrats abandon House progressives

As the election nears, the party throws its weight behind unreliable centrists

Grasping to keep control of Congress, Democratic leaders are turning their backs on some of their staunchest supporters in the House and propping up stronger candidates who have routinely defied them on health care, climate change and other major issues.

Raw politics -- the drive to win a House-majority 218 seats, no matter how -- is increasingly trumping policy and loyalty in these decisions, as Democrats shift money and attention in the closing days of the campaign toward races they can win and pull back from those seemingly lost.

The Democrats are shelling out $40 million in 59 congressional districts in the last three weeks of the campaign for TV advertising. Republicans, boosted by well-funded outside groups, are working to expand the political battleground by pouring money into 82 races next week alone.
If you want to know how the election is going, you need to read articles like these. The money is with the Republicans as well as the polls.

Democrats and Obama in a fight of their lives

Barack Obama hit the campaign trail again today in a desperate effort to save Democrats facing a Republican avalanche in next month's mid-term elections.

An Associated Press poll published today showed a quarter of those surveyed who had backed Obama in the 2008 White House election were considering voting Republican. Obama, addressing a crowd of 10,000 in Boston yesterday, acknowledged the problem. "There is no doubt that this a difficult election. That's because we've been through an incredibly difficult time as a nation," he said.

The Democrats, accepting political reality, are cancelling millions in advertising planned for Congressional candidates they no longer believe are capable of winning, and transferring the cash to shore up seats previously regarded as safe Democratic.

More of the same as the previous article.

President Obama’s faithful losing hope as the magic fades

Sometimes embellishing a story doesn’t help it or you. What’s the old saying? Sometimes it is better to remain silent and be thought a fool, than to open your mouth and remove all doubt.

Barack Obama offered up this metaphor yesterday: America’s a car that Republicans drove into a ditch.

Then along came Obama and the Democrats. “We put our boots on and went down into the ditch, and we started pushing that car out,” the president told the cheering crowd. “It was hot down there and muddy, but we kept on pushing. And every once in a while we looked up and the Republicans are standing up there tanning themselves, sipping Slurpees, and we say, ‘Hey, are you gonna help?’ ”

But the Republicans told us, said Obama, “You’re not pushing the right way.”

You’re not pushing the right way.

I don’t think the president meant to undermine anybody’s confidence with his wrong-way-out-of-the-ditch story yesterday. But that’s the nagging question — isn’t it? Even among the once-Obamified, like me? We’re afraid he’s not really getting us out of our ditch. And the ditch is getting deeper. And it’s very scary stuff

Poll: Those craving for change now look to the GOP

More nails in the Democrat coffin. Now it looks like a lot of Obamaniacs are defecting.

WASHINGTON (AP) — President Barack Obama's winning coalition from 2008 has crumbled and his core backers are dispirited. It's now Republicans who stand to benefit from an electorate that's again craving change.

Nearly two years after putting Obama in the White House, one-quarter of those who voted for the Democrat are defecting to the GOP or considering voting against the party in power this fall. Just half of them say they definitely will show up Nov. 2, according to an Associated Press-Knowledge Networks poll released two weeks before Obama's first midterm elections.

Yet in a reflection of broad dissatisfaction with politics, just as many people who backed Republican presidential nominee John McCain are either supporting Democrats now or still considering how to vote.

Still, McCain voters — to borrow Obama's campaign rallying cry — are far more "fired up, ready to go." Two-thirds say they are certain to vote next month.

Obama: Dems are in trouble because Americans aren't thinking clearly

I remember watching a movie HEAD OFFICE that was a spoof on Big Business. In it one characters, Howard Gross, was good at only one thing: denying responsibility for any actions his department took. This story reminds me of his saying, “It’s not my fault. It’s not my fault.”

At a Saturday-evening fundraiser held in the home of a wealthy Massachusetts hospital executive, President Obama suggested Democrats are having difficulties in midterm campaigning because Americans simply aren't thinking clearly. Seeking to explain his party's troubles, the president focused not on controversial legislation like national health care and the stimulus but on evolutionary psychology. "Part of the reason that our politics seems so tough right now, and facts and science and argument do not seem to be winning the day all the time, is because we're hard-wired not to always think clearly when we're scared," Obama told the assembled Democrats, who paid $15,200 a person to attend. "And the country is scared."

To "break through the fear and the frustration that people are feeling right now," Obama told the crowd, will require high-end donors not just to "write checks" but also to "lift up people's spirits and make sure that they're not reacting just to fear."
It appears to me that Obama and the Democrats are reacting to fear of the voters right now.
